When you think of a patent attorney, you might picture someone firmly rooted in legal texts. But for Lewis Mullholland<\/a>, the path into IP began thousands of miles from home\u2014embedded in an R&D team at Cisco Systems in Shanghai, tackling early cloud computing challenges.<\/p>\n\n\n\n

\u201cIt was a fascinating time,\u201d Lewis recalls. \u201cWe were pushing the boundaries of what cloud computing could do. That\u2019s where I first encountered IP\u2014not in theory, but as a practical force shaping innovation.\u201d What began as a hurdle\u2014navigating standards full of patented technologies\u2014became an inspiration. \u201cI saw patents not as obstacles but as drivers of invention. You had to think creatively around them, and that mindset stayed with me.\u201d<\/p>\n\n\n\n

Today, Lewis is a Chartered and European Patent Attorney at WP Thompson<\/a>, with a practice spanning mechanical, electrical, and software technologies. He\u2019s also a registered representative before the Unitary Patent Court, making him one of the legal professionals shaping Europe\u2019s evolving IP landscape.<\/p>\n\n\n\n

Serendipity and Strategy<\/h2>\n\n\n\n

Lewis\u2019s route into the profession wasn\u2019t entirely planned. \u201cAfter returning from China, I had a potential opportunity to train as a patent attorney in Japan. But a conversation with my grandad led to a different route\u2014a chance meeting with a Liverpool-based firm that ultimately launched my career.\u201d<\/p>\n\n\n\n

That was over a decade ago, and Lewis has stayed with WP Thompson ever since. \u201cIt just felt right,\u201d he says.<\/p>\n\n\n\n

His engineering background remains central to how he works. \u201cEngineers solve problems. Patent law, especially at the EPO, is also about solving problems\u2014framing arguments with clarity. I always try to describe an invention as though I\u2019m talking to my nan. If she can understand it, it\u2019s probably a good specification.\u201d<\/p>\n\n\n\n

Listening to Clients, Staying on the Front Line<\/h2>\n\n\n\n

Lewis\u2019s approach to staying current isn\u2019t just about journals or legal updates. \u201cI like to visit clients, talk to their R&D teams, see what\u2019s happening on the ground. That\u2019s often where you get the best insights\u2014seeing what innovations are bubbling up before they hit the headlines.\u201d<\/p>\n\n\n\n

This on-the-ground approach also helps tailor strategies for clients of all sizes. \u201cFor startups, it\u2019s about making every penny count. Tools like the UKIPO\u2019s IP Audit scheme can be game changers. For multinationals, it’s about managing large portfolios and aligning strategy with business goals.\u201d<\/p>\n\n\n\n

On AI, Ownership, and the Wild West<\/h2>\n\n\n\n

AI is an unavoidable topic in IP law\u2014and Lewis doesn\u2019t shy away from its challenges. \u201cIt\u2019s a quagmire,\u201d he admits, pointing to thorny issues like authorship of AI-generated works and ownership rights over training data. \u201cThe UK needs a more robust framework. The tech\u2019s evolving fast, and the UK\u2019s principles-based approach to AI regulation has to keep pace.\u201d<\/p>\n\n\n\n

Lewis is pragmatic about AI\u2019s place in his own profession. \u201cAI won\u2019t replace patent attorneys\u2014but it can enhance us.  We are incorporating AI into our practice, enhancing and streamlining its normal operation.  However,  there\u2019s a big caveat: it only works well in the hands of someone who knows what they\u2019re doing. You need expertise to ask the right questions and spot the hallucinations.\u201d<\/p>\n\n\n\n

High Stakes, Higher Standards<\/h2>\n\n\n\n

Lewis also has an insider\u2019s view of the UPC, Europe\u2019s new patent enforcement regime. \u201cIt\u2019s faster and cheaper\u2014but also higher risk. If a core piece of IP is critical to your business, you need to tread carefully. Many clients are cautiously sticking with the national systems, at least for now.\u201d<\/p>\n\n\n\n

His attention to detail has paid off in difficult cases. He recounts one where the client\u2019s own journal publication was blocking a grant. \u201cIt came down to a date in the metadata. I challenged the examiner\u2019s assumption and found the proof. That was the turning point. Once we removed that document from consideration, all the related objections fell away.\u201d The lesson? \u201cNever assume the examiner is right\u2014go back to first principles.\u201d<\/p>\n\n\n\n

Beyond the Desk<\/h2>\n\n\n\n

Outside the office, Lewis has a few unexpected pursuits. He\u2019s currently tackling the Couch to 5K programme and recently walked 35 miles of the Wirral Way. \u201cIt\u2019s not quite a marathon yet,\u201d he laughs, \u201cbut I\u2019m enjoying the journey.\u201d He\u2019s also revisiting classic Stephen King novels. \u201cI read \u2018Thinner\u2019 recently\u2014his early stuff has a certain edge to it.\u201d<\/p>\n\n\n\n

These interests, Lewis says, help him connect with clients. \u201cIt\u2019s about more than just law. Clients are people. If you can relate to them, they\u2019re more likely to trust you with their ideas.\u201d<\/p>\n\n\n\n

Looking Ahead<\/h2>\n\n\n\n

As for the future of IP law? \u201cAll eyes are on AI. It\u2019ll reshape how we examine, register, and enforce IP. But we need to stay human in how we use those tools. There will always be a place for patent attorneys\u2014so long as we evolve with the technology.\u201d<\/p>\n\n\n\n
